Legislative Decree No. 231 of June 8, 2001 introduced, for the first time in the Italian legal system, the concept of criminal liability for companies, which is in addition to the liability of the individual who physically committed the unlawful act, provided that the act was carried out “to the benefit of the organization”, or even simply “in the interest of the organization,” regardless of whether any actual advantage was obtained.
This applies whether the offense is committed by individuals in senior positions or by those under the direction or supervision of others, including individuals not formally part of the organizational structure, such as consultants or intermediaries.
Elen ing De Rossi srl, therefore, in order to prevent the commission of crimes within its organization and to ensure ethical and transparent business practices, has adopted an organizational, management, and control model that includes the protocols, procedures, and rules which all employees and stakeholders of the company must follow, in order to prevent the risk of committing offenses relevant under Legislative Decree 231/01.
